1.1 Ticket purchase for an Event on this MALAYSIA RUNNER website is as detailed on the online entry system on the Website and will be the fee applicable at the date of submission of the entry application. The ticket purchase is non-refundable except in accordance with these terms and conditions.

(a) No refund for wrong event, wrong run category or/and wrong participant registered.

(b) Ticket transfer only applicable within the specified event registered, where the participant wishes to transfer to another run category (within the same event) or transfer to another participant.

(c) Refer to Paragraph 1.1(b), no refund if the transfer is made from higher priced ticket to the lower priced ticket.

(d) No refund if the participant is unable to take part in the event and he/she does not wish to transfer to another participant within the valid period.

1.2 Participants enter the Event entirely at their own risks: The Organiser shall not be liable for any injury or loss occurring as a result of participation in the Event (including, without limitation, any losses resulting from the Organiser’s negligence), provided that nothing in these terms and conditions shall exclude or limit the Organiser’s liability for death or personal injury resulting from the Organiser’s negligence or for any other type of liability that cannot be excluded or limited by law.

1.3 Medical conditions:

(a) Should any medical or physical condition arise prior to the Event which is likely to affect their ability to compete in the Event, the Participant should withdraw from the Event. The Participant consents to any medical treatment being administered during the Event by official medically-qualified personnel.

(b) The Organiser may prevent the Participant from taking part in the Event (either at the start or during the Event) if the Organiser or any medical representative considers that the Participant should not participate in the Event for health and/or medical reasons.

 

2.1 The copyright and other intellectual property rights in all material on this MALAYSIA RUNNER website are owned by us or our licensors and must not be reproduced without our prior consent.

2.2 Subject to Paragraph 2.1, no part of this website may be reproduced without our prior consent.

 

3.1 We take all reasonable steps to ensure that this MALAYSIA RUNNER website is available 24 hours every day, 365 days a year. However, MALAYSIA RUNNER website does sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

4.3 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 3.2.

5.3 Malaysia Runner and all of its respective officers, employees, directors, agents, contractors and assigns shall not be liable to you for any losses whatsoever or howsoever caused (regardless of the form of action) arising directly or indirectly in connection with:
a) any access, use and/or inability to use the Platform or the Services;
b) reliance on any data or information made available through the Platform and/or through the Services. You should not act on such data or information without first independently verifying its contents;
(c) any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros; and
(d) any use of or access to any other website or webpage linked to the Platform, even if we or our officers or agents or employees may have been advised of, or otherwise might have anticipated, the possibility of the same.

5.4 Any risk of misunderstanding, error, damage, expense or losses resulting from the use of the Platform and/or Services is entirely at your own risk and we shall not be liable therefore.

6.4 You shall abide by all applicable local, state, national and international laws and regulations. Malaysia Runner reserves the right to remove any Content from the Sites or Service at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if Malaysia Runner is concerned that you may have violated the Terms of Use), or for no reason at all.

 

7.1 Neither we nor any other party (whether or not involved in producing, maintaining or delivering this MALAYSIA RUNNER website).

7.2 Nothing in these Terms shall exclude or limit liability for

(i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977);

(ii) fraud;

(iii) misrepresentation as to a fundamental matter; or

(iv) any liability which cannot be excluded or limited under the law of the Malaysia.
